Detailed verdict: Speaker overstepped jurisdiction, says Apex court




ISLAMABAD: 

National Assembly Speaker Fehmida Mirza went beyond her jurisdiction by interfering in a concluded judgment, the Supreme Court stated in its detailed verdict in the speaker ruling case on Tuesday. The speaker ruling case is based on the contempt of court case against the then prime minister, Yousaf Raza Gilani.



The judgment, authored by Chief Justice Iftikhar Muhammad Chaudhry, rejected the objections raised by Gilani's counsel Aitzaz Ahsan and Attorney General Irfan Qadir over the bench's decision to convict Gilani and over the maintainability of the petitions.


The verdict agreed with the petitioners in the case – prominent amongst them, Pakistan Muslim League-Nawaz (PML-N) and Pakistan Tehreek-e-Insaf (PTI). The chief justice held that the speaker need not have issued another verdict after a final one had been issued by the court. Instead, the court argued, she should have merely forwarded the matter to the Election Commission of Pakistan (ECP).


"The ruling of the speaker declaring that no question of disqualification of the respondent had arisen despite a concluded judgment of the apex court defied the principles of the independence of the judiciary and trichotomy of powers, and also constituted a violation of the due process clause under Article 10A of the Constitution," the top judge of the country said, adding that all this has made it a case suitable for invoking the original jurisdiction of this court.


The verdict also mentioned that the wilful and deliberate defiance of a direction in the National Reconciliation Ordinance (NRO) case brought the entire country's judiciary into ridicule.


The chief justice mentioned that since Gilani had not filed an appeal against his sentence, "the speaker had no judicial power to ignore the judgment dated 26 April, 2012 on the ground that no specific charge regarding propagation of any opinion or acting in any manner against the independence of judiciary or defaming, ridiculing the judiciary as contemplated by Article 63(1)(g) of the Constitution had been framed."


The court observed that surprisingly, the NA speaker had in fact effectively made an attempt to overrule the judgment.


The judgment also made it clear that like the speaker, the ECP cannot sit in appeal over a concluded judgment of a superior court, and has to affirm that the convicted person has become disqualified thereby rendering his seat vacant.


The fact that Gilani did not file an appeal also meant that the judgment and all its consequences attained finality, the verdict stated – including his disqualification from being a member of Parliament on and from the day of his conviction and sentence.


The judgment also recalled the concept of a trichotomy of powers, namely the legislature, executive and judiciary, in a democratic government. This trichotomy was therefore a result of the freedom people fought for in Pakistan, the court stated.

3 killed, 20 injured in Peru protest

<p>&nbsp;</p><p>At least three people were killed and 20 others were injured during clashes between security forces and demonstrators protesting a planned $4.8 billion gold mine by US-based Newmont in northern Peru.</p><p>&nbsp;</p><p>A 17-year-old was among those dead, and 15 people were also arrested at the Conga mining project, Cajamarca region prosecutor Esperanza Leon told RPP radio.</p><p>&nbsp;</p><p>More than 1,000 protesters threw stones at government offices in the town of Celendin, and police responded by firing tear gas and using their batons to disperse the crowd, local media reported.</p><p>&nbsp;</p><p>During the scuffle, two police officers were wounded by &quot;guns fired by protesters who were trying to take over Celendin,&quot; the interior ministry said in a statement. It accused the demonstrators of committing &quot;criminal acts.&quot;</p><p>&nbsp;</p><p>The Peruvian government declared a state of emergency in Cajamarca, suspending freedom of assembly, the inviolability of the home and freedom of movement. It also mobilized the military to support police operations.</p><p>&nbsp;</p><p>Protesters say the Conga mining project will pollute the area&nbsp;s lakes and rivers, contaminating water supplies.</p><p>&nbsp;</p><p>The demonstration came after Celendin Mayor Mauro Arteaga was said to have expressed support for the project.</p><p>&nbsp;</p><p>Conga was approved in 2010 by former president Alan Garcia&nbsp;s government. His successor President Ollanta Humala had been a backer of the project but insists potential environmental impacts must be weighed.</p><p>&nbsp;</p><p>The open-pit project, located some 3,700 meters (12,140 feet) above sea level, involves moving the water from four lagoons high in the Andes mountains into reservoirs the company would build.</p><p>&nbsp;</p><p>Construction is due to begin in 2014.<br />&nbsp;</p>


Blast at Bangkok oil refinery triggers huge blaze

<p>&nbsp;</p><p>An explosion at an oil refinery in an industrial area of Bangkok sparked a massive fire early Wednesday, sending a thick column of smoke into the air that could be seen across the Thai capital.</p><p>&nbsp;</p><p>No one appeared to have been injured in the blaze, which began after a loud blast at around 7.30 am local time (0030 GMT), according to a spokeswoman for the refinery firm.</p><p>&nbsp;</p><p>&quot;We are investigating the cause of fire and will inform the public immediately,&quot; said Chaveewan Kiatchokchaikul of Bangchak Petroleum, who said the fire had been brought under control.</p><p>&nbsp;</p><p>&quot;There is not much oil so people should not panic,&quot; said a local Bangkok fire fighter on Thai television.</p><p>&nbsp;</p><p>The Bangchak oil refinery, which employs around 600 people, is located in a large industrial estate in a sprawling suburb.</p><p>&nbsp;</p><p>It is among the country&nbsp;s biggest refineries and 120,000 barrels of oil are processed at the site every day, a company official told AFP.<br /><br />&nbsp;</p>


DCC approves NATO supply resumption after US apology: Kaira

<p>&nbsp;</p><p>Talking to the media, Federal Information Minister Qamar Zaman Kaira said it was in Pakistan&rsquo;s interest to facilitate US, NATO and ISAF forces in the transition process and in view of the larger interest of peace in Afghanistan and the region.</p><p>&nbsp;</p><p>He said that Pakistan would not charge any transit fees and would allow lethal cargo for Afghan security forces for the purpose of maintaining peace and stability in the region. Rehman assures foolproof security to NATO trucks

NATO truckers welcome reopen of supply, demand security

<p>&nbsp;</p><p>NATO truckers also welcomed Pakistan&nbsp;s decision to reopen supply lines into Afghanistan but said they feared Taliban attacks, demanding security guarantees before the resumption.</p><p>&nbsp;</p><p>Mir Mohammad Yousuf Shahwani, head of the largest oil tanker owners association in Pakistan, told AFP that supply trucks and tankers could be en route in &quot;days&quot; but insisted they needed protection first.</p><p>&nbsp;</p><p>&quot;It is a sudden decision but even then we can start supplies in days. The thing is, who will protect us,&quot; Shahwani said.</p><p>&nbsp;</p><p>&quot;We need security, we need protection. Pak-India foreign secretary level talks today

US to release $1.1b military aid to Pakistan: US official

ISAF commander welcomes reopening of NATO supply

Punjab cuts medicine, uplift budget by 43pc

<p><br />About Rs 26 billion have been spent on the payment of salaries of doctors, vehicles and other facilities while Rs 1.10 billion were spent for Health Professional Allowance.</p><p><br />According to documents of Punjab Finance Department, Punjab government had decided to spend Rs 12.10 for provision of medicines, x-rays machines, operation theaters, purchase of other instruments and construction of new buildings during last fiscal year but only Rs 6.30 billion could be spent in this regard.</p><p><br />It also has been revealed in documents that Rs 26 billion were spent for the payment of salaries of doctors, paramedical staff and other facilities.</p><p><br />Apart from this, Rs 1.10 billion has been paid as health professional allowance under an agreement between doctors and the government of Punjab.</p><p><br />During current fiscal year, the Punjab government has allocated Rs 166 per capita for provision of medical facilities and other development schemes in accordance with the ratio of population while Rs 832 per capita have been allocated for non-development expenditures.</p>

Karachi: Protesting teachers thrashed by police

CM responsible for patients deaths: Raja Riaz

Quetta, Peshawar doctors show solidarity with YDA

<p>&nbsp;</p><p>The patients at the hospitals in Quetta suffered a lot due to absence of the doctors.</p><p>&nbsp;</p><p>The young doctors closed OPDs of Quetta&rsquo;s two main hospitals including Civil Hospital and Bolan Medical Complex to express solidarity with the young doctors in Punjab who are on strike.</p><p>&nbsp;</p><p>The Quetta doctors had promised to continue the work despite their protest but they did not attend OPDs on the second day despite the notice taken by the Balochistan CM.</p><p>&nbsp;</p><p>More than one million patients come to get treatment from the two main hospitals of the city but the doctors continued to add public miseries due to their absence from duty.</p><p>&nbsp;</p><p>Meanwhile, provincial Doctors Association and Young Doctors Association Khyber-Pakhtunkhawa expressed solidarity with young doctors in Punjab.&nbsp;The doctors set up OPDs in lawn of the hospitals and examined the patients.</p><p>&nbsp;</p><p>They tied black ribbons on their arms and observed token protest against the arrests of doctors in Punjab.&nbsp;</p><p>&nbsp;</p><p>The representatives of the doctors associations threatened to hold protest in all hospitals of the province if their demands were not net.</p><p>&nbsp;</p><p>On the other hand, the patients&rsquo; condition worsened due to scorching heat.<br /><br />&nbsp;</p>


Faisal Raza Abidi resigns as PPP Karachi president

<p>&nbsp;</p><p>However, party sources claim that he has been removed due to complaints received from local leadership of the party.</p><p><br />Abidi was made president of the Karachi division in November last year.</p><p><br />PPP Karachi division spokesperson, Kausar Amir said that Abidi had resigned because of health reasons and had also been admitted to the hospital.</p><p><br />Sources within the party have said that the local leadership had made many complaints against him for being &ldquo;inattentive&rdquo; and had not been giving time to the party and its workers.</p><p>Abidi had earlier contested from NA-253 against Haider Abbas Rizvi of the Muttahida Qaumi Movement (MQM) during the 2008 elections.</p><p><br />He had been selected as the president of PPP&rsquo;s Karachi division after the elections but was removed after a year after complaints were received.</p><p><br />The PPP leader has been a part of the Central Executive Committee (CEC) since 2008 and member of Senate since 2009.<br />&nbsp;</p>

Today's episode was definitely more interesting than the last two. The cinematography, like always was excellent and Fawad Khan's acting and character finally seems to be shaping up. Zebu's character has mellowed down quite a lot, so no complaints there.

 

I really felt for Rohail today, the way he was 'pressurized' from left, right and centre. But if one looks at the bright side, it is actually in everyone's best interest that Rohail gets married to Zebu, to whom he is more attracted and not to Mehru who he was just going to marry to make his mother happy. What remains to be seen is that if Zebu's father and Zebu accept the proposal and how and when Bilal proposes Mehru.

 

I was surprised at the never-ending 'lecture' Mehru gave Rohail after he shared his feelings about Zebu with everyone. Mehru is the one who put him in this situation in the first place and she of all the people in the world should not be talking about values and ethics and 'your duniya' and 'my duniya', for God's sake, give the poor guy a break, he is not a puppet!

 

Rohail, no doubt wants to marry Zebu out of his own free will but the fact that he did not mention that it was actually Mehru who was involved with someone and would rather not marry him, shows that he is a gentleman. It is interesting how Deenga and his wife have something to say about everything! It is also nice to see that Madiha and Bedi Singh are part of everything that is happening with Rohail and their reactions are shown in every episode.

 

I felt totally 'uncomfortable' with the 'jism'/'wajood' dialogues today, they seemed unnecessary especially when they were being said repeatedly. It would have been great if the scenes were short and to the point. Resham's acting seems to have taken a turn for the worse. I was totally impressed with her acting in the first two episodes but now that ‘spark’ is missing. Overall today's episode focused on Rohail's confession and the aftermath and it made for an interesting fourth episode except for a few dialogues that seemed a bit unorthodox or unpleasing. I would like it if thing could unravel soon and we get to enjoy the actual story.

I must say that I take pride in the fact that Pakistani dramas are quickly becoming very diverse. We have some great writers and producers investing themselves whole-heartedly in making dramas about people and issues that most of us want to close our eyes to. Issues such as Drug addiction, where transgender persons stand in our society, how girls and their families are exploited by greedy families, who have made 'jahez' a social evil or the situation that a young adopted man would face if all of a sudden he found out that he has no blood ties with the family he has been living with for so long. Those of you who watch "Sabz Pari Laal Kabooter", "Jahez" and "Behkawa" would know what I am talking about. In my opinion it is highly commendable how these sensitive issues/social evils are being brought on-screen. Most of such plays, not just the ones I mentioned but many more before them have been a true work of art with some very adept performances to their credit.

 

Why is it then, that even with so much relevance with our social conditions such plays get hardly any attention and are mostly underrated? I was reading the comments of viewers online and I could not help but notice that majority of the people do not give these plays the respect and appreciation that they deserve. No doubt, such plays are depressing, they show the bleak and ugly side of our society which does exist but one that we would much rather close our eyes to. And that may just be the reason that these issues stay rampant and are not addressed. There is no glamour in such shows and hence people find them uninteresting.

 

My question to people who do not watch such plays purely because they think they are way too depressing is that are the plays that deal with marital problems, where a bahu is victimized constantly by a saas or by her husband not depressing? We actually like how such plays make us cry buckets but we are not willing to even remotely relate to the suffering of a family where the head of the family is too busy buying himself drugs to look after his family and other such stories. These people are just as real and relatable as the saas-bahu saga and they are not just the figment of someone's imagination. Do we want production houses to stop making such plays? Because if the viewers do not give them due attention, they just might. If that does happen in my opinion that would be a great loss for which the viewer alone is responsible.

 

It is my request to all my readers out there to kindly try and watch such plays because it is about time that we stop brushing such issues under the carpet and if we can do nothing else we can at least appreciate people who are doing their share in bringing forth the plight of those less fortunate. Personally, I highly appreciate all such efforts and I am really grateful to all those involved in such projects.

Islamic architecture: A mosque built by Mughal era techniques

Iqbal Salahuddin has a passion for Islamic architecture in Spain, Morocco, Turkey, Iran and the Subcontinent. So when building a mosque in memory of his father, he decided to borrow from them.



"I wanted to incorporate similar colour themes here," he says, pointing to the hues of blue in the under-construction mosque at a one-kanal site in Salli Town, which is named after his father Mian Salahuddin, the son-in-law of Allama Iqbal.


"The light sky blue signifies the mercy of God and it is used heavily in early Islamic scripture," says Salahuddin. Dark blue, the colour of the tiles used for the lower half of the verandah walls, signifies mysticism in Islam, he says. A golden and black arch (mehrab) signalling the direction of the Kaaba is inspired by the tomb of Bayazid Bastami in Iran.


There are inspirations from closer to home too. The floral frescoes are modelled on Masjid Wazir Khan and Masjid Bibi Khanum. Architect Kamil Khan Mumtaz, an authority on Mughal architecture, designed the building.


The structure, made of clay and mortar, took about a year to build. "A cement building may last about 200 years but clay structures can last over a thousand years," says Salahuddin.


"Using clay and mortar in place of steel, aluminium, cement and glass spares the planet," says Mumtaz. "There is no pollution, no need to import materials and hence no destruction of the environment."


The basic structure was put up in about a year, but work on the mosque has been ongoing for five years. "Finding the right tiles and the right artists to paint the frescoes was an arduous task," Salahuddin says.


These artists are Ustad Rafaqat Ali Naqqash and his sons Shafqat Ali and Majid Ali. They have been working on the Salli Town mosque for the last two years. They have finished some frescoes on the walls on the inside and are currently working on the ceilings.


Since starting his craft in 1971, Naqqash has worked on Shalamar Gardens, Khawabgah and Sheesh Mahal at the Lahore Fort, Masjid Wazir Khan and Marium Masjid near Sheranwala Gate in the Walled City.


He says painting new frescoes is easier than repairing old ones. "Restoration requires finding the exact shade used in the original and careful application of the paint to the existing fresco. This is much harder than designing and painting from the beginning," he says. Salahuddin purchased some tiles for the mosque from Nasirpur, Sindh. "It was the only place making traditional geometric patterned tiles," he says. However, unsatisfied with the quality, he requested Clayware, a company specialising in traditional pottery designs, to manufacture the tiles.


Pointing to patterned tiles bordering the domes and highlighting the boundary wall, he says these were produced by Clayware specifically for the mosque. Terracotta tiles that will form the mosque's floors are yet to be installed.


He is hopeful the mosque, which will have a capacity for 500 worshippers, will be completed between December and March 2013.


Mumtaz, though, does not expect others to follow them in adopting Mughal era techniques to build. "Modern developers do not appreciate the historical appeal of buildings and these techniques are labour intensive. That means the poor make money. Developers are interested in their own profits only."
